By downloading, installing, or using DailyWell ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and DailyWell (operated by Hekax) regarding your use of the App and related services.
2. Description of Service
DailyWell is a wellness and habit tracking application that provides:
- Habit tracking for 7 core wellness areas
- AI-powered coaching using Claude by Anthropic
- Progress analytics and insights
- Social and family features
- Health Connect integration (optional)
- Premium subscription features
3. User Accounts
3.1 Account Creation
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
3.2 Account Termination
We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited conduct.
4. Subscriptions & Payments
4.1 Free Tier
The free tier includes basic habit tracking for 7 habits, reminders, streaks, and achievements. No payment is required for the free tier.
4.2 Premium Subscription
Premium features require a paid subscription. Subscription options include:
- Monthly: $4.99/month
- Annual: $23.99/year (60% savings)
- Family Plan: Available for up to 5 members
4.3 Billing
Payments are processed through Google Play. By subscribing, you authorize recurring charges until you cancel. Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
4.4 Refunds
We offer a 30-day money-back guarantee for annual subscriptions. Refund requests should be sent to support@hekax.com
5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer or hack the App
- Interfere with the App's security features
- Share your account with others
- Upload harmful content or malware
- Abuse or harass other users
- Misuse the AI coaching feature
- Circumvent subscription restrictions
6. AI Coaching Disclaimer
The AI coaching feature is designed to provide motivational support and habit guidance. It is NOT:
- A substitute for professional medical advice
- A replacement for mental health treatment
- A diagnostic tool for any condition
- Professional therapy or counseling
If you are experiencing a medical or mental health emergency, please contact appropriate emergency services or healthcare providers immediately.
7. Intellectual Property
All content, features, and functionality of the App are owned by DailyWell and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.
You retain ownership of any content you create (habit data, notes, etc.) but grant us a license to use this content to provide and improve the Service.
8. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "as is" without warranties of any kind
- We do not guarantee uninterrupted or error-free service
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service in the past 12 months
10. Indemnification
You agree to indemnify and hold harmless DailyWell, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to conflict of law principles.
